HOUSE BILL No. 4673

 

May 24, 2011, Introduced by Rep. Walsh and referred to the Committee on Judiciary.

 

     A bill to amend 1949 PA 42, entitled

 

"An act to confer power upon the circuit court of this state to

include in decrees of divorce and of separate maintenance

provisions awarding to a party all or part of the property, either

real or personal, owned by his or her spouse if the facts establish

that the party contributed to the acquisition, improvement, or

accumulation of the property,"

 

by amending section 1 (MCL 552.401), as amended by 1983 PA 215.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) The circuit court of this state may include in any

 

decree of In a judgment entered in an action for divorce or of

 

separate maintenance, entered in the circuit a court appropriate

 

provisions awarding shall award to a party all or a portion of the

 

property, either real or personal, owned by his or her spouse, as

 

appears to the court to be equitable under all the circumstances of

 

the case, if it appears from the evidence in the case that the

 

party contributed to the acquisition, improvement, or accumulation


 

of the property. The decree, upon provided in section 19 of 1846 RS

 

84, MCL 552.19.

 

     (2) A judgment of divorce referred to in subsection (1), on

 

becoming final, shall have has the same force and effect as would a

 

quitclaim deed of the real estate, if any the property awarded is

 

real estate, or a bill of sale of the personal property, if any the

 

property awarded is personal property, given by the party's spouse

 

to the party.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 4672(request no.

 

02213'11 *) of the 96th Legislature is enacted into law.
