HOUSE BILL NO. 4973

A bill to amend 1909 PA 283, entitled

"An act to revise, consolidate, and add to the laws relating to the establishment, opening, discontinuing, vacating, closing, altering, improvement, maintenance, and use of the public highways and private roads; the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; maintaining public access to waterways under certain conditions; setting and protecting shade trees, drainage, and cutting weeds and brush within this state; providing for the election or appointment and defining the powers, duties, and compensation of state, county, township, and district highway officials; and to prescribe penalties and provide remedies,"

by amending section 7 of chapter X (MCL 230.7).

the people of the state of michigan enact:

CHAPTER X

Sec. 7. Whoever shall injure any A person that injures a bridge maintained at the public charge, expense, or any a public road, by drawing logs or timber on the surface of any such the road or bridge, or by any other act, shall be is liable in damages to 3 times the amount of the injury, to be recovered in an a civil action, of trespass or on the case, brought by the commissioner of highways of the township within which the injury was done, in his name of office, governmental entity with jurisdiction over the bridge or road, to be expended by him in the repair of roads in his township.under the jurisdiction of the governmental entity.
