HOUSE BILL No. 5008

 

September 27, 2011, Introduced by Reps. Lipton, Bledsoe, Tlaib, Hovey-Wright, Brown, Slavens, Kandrevas, Talabi, Jackson, Darany, Santana, Durhal, Stallworth, Howze and Oakes and referred to the Committee on Energy and Technology.

 

     A bill to prescribe the powers and duties of certain state

 

agencies and officials; to authorize certain charges to be included

 

in electric and natural gas utility rates; and to create a fund.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "low-

 

income and energy efficiency act".

 

     Sec. 3. As used in this act:

 

     (a) "Commission" means the Michigan public service commission.

 

     (b) "Electric utility" means that term as defined in section 2

 

of the electric transmission line certification act, 1995 PA 30,

 

MCL 460.562.

 

     (c) "Fund" means the low-income and energy efficiency fund

 

created in section 5.

 

     (d) "Low-income and energy efficiency funding factor" means a


 

charge to customers of an electric utility or natural gas utility

 

to help fund the low-income and energy efficiency fund.

 

     (e) "Natural gas utility" means that term as defined in

 

section 9 of 1939 PA 3, MCL 460.9.

 

     Sec. 5. (1) The low-income and energy efficiency fund is

 

created within the state treasury.

 

     (2) The state treasurer may receive money or other assets from

 

any source for deposit into the fund. The state treasurer shall

 

direct the investment of the fund. The state treasurer shall credit

 

to the fund interest and earnings from fund investments.

 

     (3) Money in the fund at the close of the fiscal year shall

 

remain in the fund and shall not lapse to the general fund.

 

     (4) The commission shall be the administrator of the fund for

 

auditing purposes.

 

     (5) The commission shall expend money from the fund, upon

 

appropriation, only for 1 or more of the following purposes:

 

     (a) To provide shut-off and other protection for low-income

 

customers.

 

     (b) To promote energy efficiency by all customer classes.

 

     Sec. 7. The commission may include a low-income and energy

 

efficiency funding factor in an electric utility's or natural gas

 

utility's base rates.

 

     Enacting section 1. This act is retroactive and is effective

 

October 6, 2008.
