A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
by amending section 1974 (MCL 600.1974).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
1974. (1) The filing of pleadings and other papers
documents with the court shall be made by filing them with the
office of the clerk of the court, except that the judge may permit
the
papers documents to be filed with him or her, in which event
he
case
the judge shall note thereon the
filing date on the documents
and
forthwith shall transmit them the documents to the office
of
the clerk of the court.
(2) In the case of a pleading or other document filed by a
prisoner who is incarcerated in a state correctional facility and
is representing himself or herself without legal counsel, the
document, if it pertains to the prisoner's appeal of his or her
criminal conviction or another criminal matter involving the
prisoner, shall be considered to be filed on the date that it is
posted with the United States postal service.
