SENATE BILL No. 221

 

 

February 12, 2009, Introduced by Senator JELINEK and referred to the Committee on Judiciary.

 

 

 

      A bill to amend 1927 PA 175, entitled

 

"The code of criminal procedure,"

 

by amending section 44 of chapter VII and section 16a of chapter

 

XVII (MCL 767.44 and 777.16a), section 16a of chapter XVII as

 

amended by 2004 PA 216.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1                           CHAPTER VII

 

 2        Sec. 44. The following forms may be used in the cases in

 

 3  which they are applicable but any other forms authorized by this

 

 4  or any other law of this state may also be used:

 

 5        Adultery—A.B., a married man, committed adultery with C.D.;

 

 6  or A.B. committed adultery with C.D., a married woman.

 

 7        Affray—A.B. and C.D. made an affray.


 

 1        Assault—A.B. assaulted C.D.

 

 2        Assault and Battery—A.B. committed an assault and battery on

 

 3  C.D.

 

 4        Assault with intent—A.B. assaulted C.D. with intent to

 

 5  murder, or kill, or rob, or maim, or rape (as the case may be).

 

 6        Arson—A.B. committed arson by burning the dwelling house of

 

 7  C.D.

 

 8        Attempt—A.B. attempted to steal from C.D.; A.B. attempted to

 

 9  commit larceny of the goods of C.D.; A.B. attempted to commit

 

10  burglary of a building belonging to C.D. (as the case may be).

 

11        Burglary—A.B. committed burglary of the house of C.D. A.B.

 

12  broke and entered the dwelling house of C.D. in the night time

 

13  with intent to commit larceny, or murder, or robbery therein (as

 

14  the case may be).

 

15        Conspiracy—A.B. and C.D. conspired together to murder E.F.

 

16  or to steal the property of E.F. or to rob E.F. (as the case may

 

17  be).

 

18        Forgery—A.B. forged a certain instrument purporting to be a

 

19  promissory note (or describe instrument or give its tenor or

 

20  substance).

 

21        Larceny—Embezzlement and false pretenses. A.B. stole from

 

22  C.D. 1 horse of the value of more than 100 dollars.

 

23        Murder—A.B. murdered C.D.

 

24        Manslaughter—A.B. killed C.D.

 

25        Perjury—A.B. appeared as a witness in a case between C.D.

 

26  and E.F. being heard before the (set forth the tribunal) and

 

27  committed perjury by testifying as follows: (set forth the


 

 1  testimony).

 

 2        Rape—A.B. raped or ravished C.D.

 

 3        Rape (statutory)—A.B. raped or ravished C.D., she C.D. being

 

 4  then under the age of (statutory age) years.

 

 5        Robbery Armed—A.B. robbed C.D., A.B. being armed.

 

 6        Robbery—A.B. robbed C.D., A.B. not being armed.

 

 7        Provided, That the prosecuting attorney, if seasonably

 

 8  timely requested by the respondent, shall furnish a bill of

 

 9  particulars setting up specifically the nature of the offense

 

10  charged.

 

11                           CHAPTER XVII

 

12        Sec. 16a. This chapter applies to the following felonies

 

13  enumerated in chapter 750 of the Michigan Compiled Laws:
