SENATE BILL No. 321

 

 

March 4, 2009, Introduced by Senators KAHN, GEORGE, HARDIMAN and PAPPAGEORGE and referred to the Committee on Health Policy.

 

 

 

     A bill to amend 1974 PA 258, entitled

 

"Mental health code,"

 

(MCL 330.1001 to 330.2106) by adding section 204c.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 204c. The board of a community mental health services

 

authority or organization formed under this chapter in furtherance

 

of the public purpose of meeting the needs of the populations

 

served by that authority or organization in this state may, by

 

resolution, authorize the formation of a nonprofit entity to

 

provide information technology and other integral administrative

 

support services for organizations engaged in providing mental

 

health services, behavioral health services, social services,

 

substance abuse services, human services, or other health care

 


services. The community mental health services authority or

 

organization may also enter into contracts with and may provide

 

funding for or receive funding from that nonprofit entity for those

 

purposes. Funds received by the community mental health services

 

authority or organization from a nonprofit entity described in this

 

section shall be considered local funds and shall not be used to

 

support or match any federal programs. No funds from state

 

appropriations allocated to the community mental health services

 

authority or organization or federal funds shall be used to

 

establish the nonprofit entity.
