SENATE BILL NO. 588

June 30, 2021, Introduced by Senators HERTEL, WOJNO, MCCANN, MCMORROW, ANANICH, CHANG, BARRETT, GEISS, IRWIN, STAMAS, ALEXANDER, BULLOCK and HORN and referred to the Committee on Health Policy and Human Services.

A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 10251.

the people of the state of michigan enact:

Sec. 10251. (1) A person that performs organ transplants in this state shall not refuse to transplant an organ in a transplant recipient who is physically or mentally disabled based solely on the transplant recipient's physical or mental disability.

(2) A person that performs organ transplants in this state shall not refuse to transplant an organ in a transplant recipient based on an assessment that the recipient will be unable, without support, to comply with post-transplantation medical requirements because of a mental disability. A person that performs organ transplants in this state shall consider a transplant recipient's support in determining the recipient's ability to comply with post-transplantation medical requirements.

(3) A person that violates this section may be restrained or enjoined from violating this section in an injunctive action as otherwise provided by law. The injunctive action must be heard in an expedited manner.

(4) As used in this section, "organ" means that term as defined in section 10102.
