1.2relating to liquor; imposing a criminal penalty for social host liability;amending
1.3Minnesota Statutes 2010, section 340A.90, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 340A.90, is amended by adding a
1.6subdivision to read:
1.7 Subd. 4. Social host liability; gross misdemeanor. (a) A person 21 years of age or
1.8older who: (1) had control over the premises and, being in a reasonable position to prevent
1.9the consumption of alcoholic beverages by a person under the age of 21 years, knowingly
1.10or recklessly permitted that consumption and the consumption caused the intoxication of
1.11that person; or (2) sold, bartered, furnished or gave to, or purchased for a person under the
1.12age of 21 years alcoholic beverages that caused the intoxication of that person is guilty,
1.13upon a second conviction, of a gross misdemeanor.
1.14(b) Paragraph (a) does not apply to the landlord or manager of a multiple dwelling
1.15or rental residential property who does not actively participate in providing an alcoholic
1.16beverage to a person under the age of 21 years.
1.17EFFECTIVE DATE.This section is effective August 1, 2011, and applies to crimes
1.18committed on or after that date.
