1.1A bill for an act
1.2relating to state finance; requiring a balanced budget prior to passage of other
1.3legislation;proposing coding for new law in Minnesota Statutes, chapter 16A.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [16A.112] PRIORITY FOR PASSAGE OF BALANCED BUDGET.
1.6    Subdivision 1. General fund balanced budget. Notwithstanding any law to
1.7the contrary, the legislature must balance the general fund budget before passing any
1.8conference committee reports or identical bills to enact changes to Minnesota law that are
1.9not applicable to the general fund budget or to appropriate money from a nongeneral fund
1.10account or fund or to authorize state general obligation bonds and appropriate money from
1.11the bond proceeds fund under section 16A.631 for capital projects. The budget must be
1.12balanced by the passage of one or more conference committee reports or identical bills
1.13in both houses that have the effect of balancing general fund revenues and expenditures
1.14based on the forecasts under section 16A.103. In an even-numbered year, the legislature
1.15must pass a balanced budget for the current biennium based on the November forecasts in
1.16the previous odd-numbered year. In an odd-numbered year, the legislature must pass a
1.17balanced budget for both the current and subsequent biennium based on the most recent
1.18forecasts.
1.19    Subd. 2. Rules. Each house of the legislature must provide by rule that it will pass a
1.20balanced general fund budget before passing any legislation that is not directly related to
1.21balancing general fund revenue and expenditures for the current or subsequent biennium
1.22based on the forecasts under section 16A.103.
1.23EFFECTIVE DATE.This section is effective the day following final enactment.
