1.1A bill for an act
1.2relating to elections; requiring candidates for federal office to agree to uphold
1.3and assert rights and privileges provided in the Constitution of the United States
1.4and the Constitution of the state of Minnesota; amending Minnesota Statutes
1.52012, section 204B.06, subdivision 4.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2012, section 204B.06, subdivision 4, is amended to read:
1.8    Subd. 4. Federal offices. (a) Candidates for president or vice president of the
1.9United States are not required to file an affidavit of candidacy for office. Candidates
1.10who seek nomination for the office of United States senator or representative shall state
1.11the following information on the affidavit:
1.12(1) for United States senator, that the candidate will be an inhabitant of this state
1.13when elected and will be 30 years of age or older and a citizen of the United States for not
1.14less than nine years on the next January 3 or, in the case of an election to fill a vacancy,
1.15within 21 days after the special election; and
1.16(2) for United States representative, that the candidate will be an inhabitant of this
1.17state when elected and will be 25 years of age or older and a citizen of the United States
1.18for not less than seven years on the next January 3 or, in the case of an election to fill a
1.19vacancy, within 21 days after the special election.
1.20(b) A candidate who seeks nomination for the office of United States senator or
1.21representative shall also state on the affidavit that, if elected, the candidate agrees to
1.22uphold and assert all rights and privileges granted to the people of the state of Minnesota,
1.23as provided in the Constitution of the United States and as provided in the Constitution
1.24of the state of Minnesota.
