1.1A bill for an act
1.2relating to labor and employment; modifying prevailing wage provisions;
1.3amending Minnesota Statutes 2010, sections 177.42, subdivision 4; 177.43,
1.4subdivision 7.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 177.42, subdivision 4, is amended to read:
1.7    Subd. 4. Prevailing hours of labor. "Prevailing hours of labor" means the hours
1.8of labor per day and per week worked within the area by a larger number of workers of
1.9the same class than are employed within the area for any other number of hours per day
1.10and per week. The prevailing hours of labor may not be more than eight ten hours per
1.11day or more than 40 hours per week. As used in this section, "week" applies to work
1.12performed Monday through Saturday.

1.13    Sec. 2. Minnesota Statutes 2010, section 177.43, subdivision 7, is amended to read:
1.14    Subd. 7. Applicability. This section does not apply to a contract, or work under
1.15a contract, under which:
1.16(1) the estimated total cost of completing the project is less than $2,500 and only one
1.17trade or occupation is required to complete it, or
1.18(2) the estimated total cost of completing the project is less than $25,000 and more
1.19than one trade or occupation is required to complete it $500,000. The commissioner
1.20shall make an annual adjustment to the project threshold in this subdivision according
1.21to the Producer Price Index for nonresidential construction, published by the United
1.22States Bureau of Labor Statistics.
