1.2relating to civil law; extending civil immunity to municipalities that donate fire
1.3and rescue equipment;amending Minnesota Statutes 2010, section 466.03, by
1.4adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 466.03, is amended by adding a
1.7subdivision to read:
1.8 Subd. 23. Donated fire and rescue equipment. (a) A tort claim resulting from the
1.9use of fire and rescue equipment donated by a municipality to another municipality, unless
1.10the claim is a direct result of fraud or intentional misrepresentation.
1.11(b) As used in this subdivision, "fire and rescue equipment" means equipment
1.12purchased or obtained through gifts or grants by a municipality for use by the
1.13municipality's fire department to engage in or train for fire or rescue operations.
1.14EFFECTIVE DATE.This section is effective August 1, 2011, and applies to
1.15actions arising from incidents occurring on or after that date.
