1.2relating to traffic regulations; increasing penalties for unlawful passing on the
1.3right resulting in bodily injury or death;amending Minnesota Statutes 2010,
1.4section 169.18, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 169.18, is amended by adding a
1.7subdivision to read:
1.8 Subd. 4a. Passing on the right resulting in bodily injury or death. (a) It is a
1.9violation for a driver to pass on the right or the shoulder of a road or highway except:
1.10(1) in accordance with subdivision 4;
1.11(2) when operating a bus on a shoulder in accordance with section 169.306;
1.12(3) when passing on a dynamic shoulder lane as authorized by section 160.93;
1.13(4) when operating an authorized emergency vehicle while responding to an
1.14emergency;
1.15(5) when directed to do so by a peace officer; or
1.16(6) when necessary to avoid a traffic accident or injury to self or another.
1.17(b) A person who commits a violation of paragraph (a) resulting in substantial or
1.18great bodily harm, as defined in section 609.02, subdivision 7a or 8, is guilty of a gross
1.19misdemeanor.
1.20(c) A person who commits a violation of paragraph (a) resulting in death is guilty of
1.21a felony.
1.22EFFECTIVE DATE.This section is effective August 1, 2011, for violations
1.23committed on or after that date.
