1.2relating to crime; modifying the penalty for criminal neglect;amending
1.3Minnesota Statutes 2010, section 609.233, subdivision 1, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 609.233, subdivision 1, is amended to read:
1.6 Subdivision 1. Crime. A caregiver or operator who intentionally neglects a
1.7vulnerable adult or knowingly permits conditions to exist that result in the abuse or
1.8neglect of a vulnerable adult is guilty of agross misdemeanor crime. For purposes of this
1.9section, "abuse" has the meaning given in section626.5572, subdivision 2 , and "neglect"
1.10means a failure to provide a vulnerable adult with necessary food, clothing, shelter, health
1.11care, or supervision.
1.12EFFECTIVE DATE.This section is effective August 1, 2012, and applies to crimes
1.13committed on or after that date.
1.14 Sec. 2. Minnesota Statutes 2010, section 609.233, is amended by adding a subdivision
1.15to read:
1.16 Subd. 3. Penalties. A person who violates subdivision 1 may be sentenced as
1.17follows:
1.18(1) if the act results in great bodily harm, imprisonment for not more than ten years
1.19or payment of a fine of not more than $20,000, or both;
1.20(2) if the act results in substantial bodily harm or the risk of death, imprisonment for
1.21not more than five years or payment of a fine of not more than $10,000, or both; or
2.1(3) in other cases, imprisonment for not more than one year or payment of a fine of
2.2not more than $3,000, or both.
2.3EFFECTIVE DATE.This section is effective August 1, 2012, and applies to crimes
2.4committed on or after that date.
