1.2relating to civil commitment; requiring the committing court to annually review
1.3the necessity and conditions of a person's commitment; requiring the state court
1.4administrator to report information on committed persons to the commissioner of
1.5human services; proposing coding for new law in Minnesota Statutes, chapter
1.6253B.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.8 Section 1. [253B.223] ANNUAL COURT REVIEW.
1.9The committing court shall retain jurisdiction over a person for the period of time
1.10that person is committed to the commissioner as developmentally disabled or mentally ill
1.11and dangerous. In addition to any other review hearings or appeals required or permitted
1.12under this chapter, the committing court shall annually hold a review hearing of a person's
1.13commitment as developmentally disabled or mentally ill and dangerous to determine
1.14whether continued commitment is needed for that person and the placement and treatment
1.15the person is receiving continues to be appropriate.
1.16 Sec. 2. [253B.25] TRANSFER OF COMMITMENT INFORMATION.
1.17Notwithstanding section 253B.23, subdivision 9, no less than biannually the state
1.18court administrator shall electronically transmit to the commissioner the following
1.19information on all persons a state court has committed to the commissioner:
1.20(1) name and birthdate;
1.21(2) type of commitment;
1.22(3) time period of commitment;
1.23(4) all facilities and programs to which the person has been committed; and
1.24(5) any other pertinent information.
