1.1A bill for an act
1.2relating to consumer protection; regulating certain gasoline sales near terminals;
1.3prescribing penalties;proposing coding for new law in Minnesota Statutes,
1.4chapter 325D.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [325D.671] RETAIL SALES NEAR GASOLINE TERMINALS.
1.7A person, firm, company, association, or corporation, foreign or domestic, doing
1.8business in this state as the owner and operator of both a gasoline terminal and two or
1.9more retail locations offering the sale of gasoline by way of posted price or indicating
1.10meter may not charge gasoline customers of the retail locations within seven miles of the
1.11terminal more than the lowest price offered by any of the retail locations under the same
1.12ownership located within 35 miles of the terminal.
1.13A violation of this section is a violation of section 325D.67, except that the criminal
1.14penalties in section 325D.67, subdivision 2, do not apply. In addition to the penalties
1.15for violations and the remedies provided for injured parties set forth elsewhere in this
1.16chapter, the commissioner of commerce may use the authority under section 45.027 for
1.17the purpose of preventing violations of this section.
