1.1A bill for an act
1.2relating to school board elections; providing a process to dissolve election
1.3districts without entering into a consolidation or cooperation and combination
1.4plan;amending Minnesota Statutes 2012, section 205A.12, subdivision 7.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 205A.12, subdivision 7, is amended to read:
1.7    Subd. 7. Dissolution of election districts. (a) In the ten largest school districts or
1.8in a school district located wholly or partly within a city of the first class, the governing
1.9body of a school district that enters into a consolidation or cooperation and combination
1.10agreement may, by resolution, dissolve election districts previously established as
1.11provided in this section as part of the consolidation or cooperation and combination plan.
1.12The resolution must include a plan for the orderly transition to at-large elections of school
1.13board members. The largest ten districts shall be determined each year ending in one
1.14based on the number of pupils enrolled in the district on October 1 of the previous fiscal
1.15year. Notwithstanding the requirements of this paragraph, the initial determination shall
1.16be based on the number of pupils enrolled in the district on October 1, 2013.
1.17(b) In all districts not subject to paragraph (a), upon resolution of the board, made on
1.18its own motion or on presentation of a petition substantially in the form required in section
1.19205A.13, signed by at least 50 electors of the district or ten percent of the number of votes
1.20cast in the most recent regular school board election, whichever is larger, the board shall
1.21adopt a proposal to dissolve election districts previously established. The proposal must
1.22include a plan for the orderly transition to at-large elections of school board members. The
1.23proposal must be submitted to the voters at the next general election. If the election is
1.24initiated by petition, the resolution calling the election must be adopted within six months
2.1after the date of receipt of the petition. Only one election within any two-year period may
2.2be held under this section. The question presented at the general election shall be:
