1.2relating to public beaches; requiring lifeguards at public beaches to have certain
1.3minimum training;proposing coding for new law in Minnesota Statutes, chapter
1.4471.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [471.155] PUBLIC BEACHES; LIFEGUARDS.
1.7 Subdivision 1. Definitions. For the purposes of this section:
1.8(1) "political subdivision" means a statutory or home rule charter city, county, town,
1.9or other political subdivision; and
1.10(2) "public swimming beach" means an area abutting a body of water, other than
1.11a swimming pool governed by section 144.1222, owned or operated by the political
1.12subdivision, whether directly or under agreement with another public or private entity,
1.13intended to be open to the public for swimming.
1.14 Subd. 2. Lifeguards. If a political subdivision provides for lifeguards to be present
1.15at a public swimming beach, each lifeguard must be certified in first aid and adult, child,
1.16and infant cardiopulmonary resuscitation, have American Red Cross lifeguard certification
1.17or the equivalent, and be responsible for the supervision and safety of persons at the public
1.18swimming beach while on duty.
1.19 Subd. 3. Citation. This section may be cited as "Tony Caine's Law."
1.20EFFECTIVE DATE.This section is effective January 1, 2015.
