1.2relating to motor vehicles; modifying fees for transactions relating to motor
1.3vehicles and drivers' licenses; amending Minnesota Statutes 2010, sections
1.4168.33, subdivision 7; 171.06, subdivisions 2, 2a.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 168.33, subdivision 7, is amended to read:
1.7 Subd. 7. Filing fees; allocations. (a) In addition to all other statutory fees and
1.8taxes, a filing fee of:
1.9(1)$4.50 $6 is imposed on every vehicle registration renewal, excluding pro rate
1.10transactions; and
1.11(2)$8.50 $10 is imposed on every other type of vehicle transaction, including pro
1.12rate transactions;
1.13except that a filing fee may not be charged for a document returned for a refund or for
1.14a correction of an error made by the Department of Public Safety, a dealer, or a deputy
1.15registrar. The filing fee must be shown as a separate item on all registration renewal
1.16notices sent out by the commissioner. No filing fee or other fee may be charged for the
1.17permanent surrender of a title for a vehicle.
1.18(b) The statutory fees and taxes, and the filing fees imposed under paragraph (a)
1.19may be paid by credit card or debit card. The deputy registrar may collect a surcharge
1.20on the statutory fees, taxes, and filing fee not greater than the cost of processing a credit
1.21card or debit card transaction, in accordance with emergency rules established by the
1.22commissioner of public safety. The surcharge must be used to pay the cost of processing
1.23credit and debit card transactions.
2.1(c) All of the fees collected under paragraph (a), clause (1), by the department, must
2.2be paid into the vehicle services operating account in the special revenue fund under
2.3section299A.705 . Of the fee collected under paragraph (a), clause (2), by the department,
2.4$3.50 must be paid into the general fund with the remainder deposited into the vehicle
2.5services operating account in the special revenue fund under section299A.705 .
2.6 Sec. 2. Minnesota Statutes 2010, section 171.06, subdivision 2, is amended to read:
2.7 Subd. 2. Fees. (a) The fees for a license and Minnesota identification card are
2.8as follows:
2.37In addition to each fee required in this paragraph, the commissioner shall collect a
2.38surcharge of $1.75 until June 30, 2012. Surcharges collected under this paragraph must be
2.39credited to the driver and vehicle services technology account in the special revenue fund
2.40under section299A.705 .
2.41 (b) Notwithstanding paragraph (a), an individual who holds a provisional license and
2.42has a driving record free of (1) convictions for a violation of section169A.20 ,
169A.33 ,
2.43169A.35
, or sections
169A.50 to
169A.53 , (2) convictions for crash-related moving
3.1violations, and (3) convictions for moving violations that are not crash related, shall have a
3.2$3.50 credit toward the fee for any classified under-21 driver's license. "Moving violation"
3.3has the meaning given it in section171.04, subdivision 1 .
3.4 (c) In addition to the driver's license fee required under paragraph (a), the
3.5commissioner shall collect an additional $4 processing fee from each new applicant
3.6or individual renewing a license with a school bus endorsement to cover the costs for
3.7processing an applicant's initial and biennial physical examination certificate. The
3.8department shall not charge these applicants any other fee to receive or renew the
3.9endorsement.
3.10(d) In addition to the fee required under paragraph (a), a driver's license agent may
3.11charge and retain a filing fee under section 171.061, subdivision 4.
3.12 Sec. 3. Minnesota Statutes 2010, section 171.06, subdivision 2a, is amended to read:
3.13 Subd. 2a. Two-wheeled vehicle endorsement fee. (a) The fee for any duplicate
3.14driver's license obtained for the purpose of adding a two-wheeled vehicle endorsement
3.15is increased by$18.50 $13.50 for each first such duplicate license and $13 $8 for each
3.16renewal thereof. The additional fee must be paid into the state treasury and credited
3.17as follows:
3.18(1) $11 of the additional fee for each first duplicate license, and $7 of the additional
3.19fee for each renewal, must be credited to the motorcycle safety fund, which is hereby
3.20created; provided that ten percent of fee receipts in excess of $750,000 in a fiscal year
3.21must be credited to the general fund.
3.22(2) The remainder of the additional fee must be credited to the general fund.
3.23(b) All application forms prepared by the commissioner for two-wheeled vehicle
3.24endorsements must clearly state the amount of the total fee that is dedicated to the
3.25motorcycle safety fund.
3.26(c) In addition to the fee required under paragraph (a), a driver's license agent may
3.27charge and retain a filing fee under section 171.061, subdivision 4. The department shall
3.28charge the same amount as an agent under section 171.061, which must be credited to the
3.29driver services operating account in section 299A.705, subdivision 2.
3.30 Sec. 4. EFFECTIVE DATE.
3.31Sections 1 to 3 are effective July 1, 2011.
