1.1A bill for an act
1.2relating to liquor; authorizing cities to issue license for sales at a stadium or
1.3ballpark for the purposes of summer collegiate league baseball games;amending
1.4Minnesota Statutes 2010, section 340A.404, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 340A.404, subdivision 1, is amended to
1.7read:
1.8    Subdivision 1. Cities. (a) A city may issue an on-sale intoxicating liquor license to
1.9the following establishments located within its jurisdiction:
1.10(1) hotels;
1.11(2) restaurants;
1.12(3) bowling centers;
1.13(4) clubs or congressionally chartered veterans organizations with the approval of
1.14the commissioner, provided that the organization has been in existence for at least three
1.15years and liquor sales will only be to members and bona fide guests, except that a club
1.16may permit the general public to participate in a wine tasting conducted at the club under
1.17section 340A.419;
1.18(5) sports facilities located on land owned by the Metropolitan Sports Commission;
1.19and
1.20(6) exclusive liquor stores.
1.21(b) A city may issue an on-sale intoxicating liquor license, an on-sale wine license,
1.22or an on-sale malt liquor license to a theater within the city, notwithstanding any law, local
1.23ordinance, or charter provision. A license issued under this paragraph authorizes sales on
1.24all days of the week to persons attending events at the theater.
2.1(c) A city may issue an on-sale intoxicating liquor license, an on-sale wine license,
2.2or an on-sale malt liquor license to a convention center within the city, notwithstanding
2.3any law, local ordinance, or charter provision. A license issued under this paragraph
2.4authorizes sales on all days of the week to persons attending events at the convention
2.5center. This paragraph does not apply to convention centers located in the seven-county
2.6metropolitan area.
2.7(d) A city may issue an on-sale wine license and an on-sale malt liquor license to
2.8a person who is the owner of a summer collegiate league baseball team, or to a person
2.9holding a concessions or management contract with the owner, for beverage sales at a
2.10ballpark or stadium located within the city for the purposes of summer collegiate league
2.11baseball games at the ballpark or stadium, notwithstanding any law, local ordinance, or
2.12charter provision. A license issued under this paragraph authorizes sales on all days of the
2.13week to persons attending baseball games at the ballpark or stadium.
