1.2relating to economic development; creating the Trade Policy Advisory Council;
1.3proposing coding for new law in Minnesota Statutes, chapter 116J.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [116J.9661] TRADE POLICY ADVISORY COUNCIL.
1.6 Subdivision 1. Establishment. The Trade Policy Advisory Council is established
1.7to advise and assist the governor and the legislature regarding government procurement
1.8agreements of United States trade agreements.
1.9 Subd. 2. Membership. (a) The Trade Policy Advisory Council shall have 14
1.10members, as follows:
1.11(1) the commissioner of employment and economic development or designee;
1.12(2) the commissioner of agriculture or designee;
1.13(3) two senators, including one appointed by the Subcommittee on Committees of the
1.14Committee on Rules and Administration, and one appointed by the minority leader; and
1.15(4) two members of the house of representatives, including one member appointed
1.16by the speaker of the house and one member appointed by the minority leader; and
1.17(5) eight members appointed by the governor. The governor's appointees shall
1.18represent specified interests, as follows:
1.19(i) two representatives of organized labor;
1.20(ii) a representative of an organization representing environmental interests;
1.21(iii) a representative from each of two separate organizations representing family
1.22farmers;
1.23(iv) two representatives from business and industry;
2.1(v) a representative of a nonprofit organization focused on international trade and
2.2development.
2.3(b) The Trade Policy Advisory Council may invite representatives from other state
2.4agencies, industries, trade and labor organizations, nongovernmental organizations, and
2.5local governments to join the council as nonvoting ex officio members.
2.6(c) Except for initial appointments, the appointing authorities shall make
2.7appointments by the first Monday in January of every odd-numbered year.
2.8 Subd. 3. Term. Except for the initial appointees, members of the Trade Policy
2.9Advisory Council shall serve for a term of two years and may be reappointed. Members
2.10shall serve until their successors have been appointed.
2.11 Subd. 4. Administration. The commissioner of employment and economic
2.12development or the commissioner's designee shall provide meeting space and
2.13administrative services for the council.
2.14 Subd. 5. Initial appointments and first meeting. The appointing authorities shall
2.15appoint the first members of the council by September 15, 2013. The first appointees shall
2.16serve until the first Monday in January, 2015. The commissioner of the Department of
2.17Employment and Economic Development shall convene the first meeting by December
2.1815, 2013, and shall act as chair until the council elects a chair at its first meeting.
2.19 Subd. 6. Chair. The members shall elect a chair from the legislative members
2.20of the advisory council.
2.21 Subd. 7. No compensation. Public members of the advisory council serve without
2.22compensation or payment of expenses.
2.23 Subd. 8. Duties. The Trade Policy Advisory Council shall:
2.24(1) advise the governor and the legislature on matters relating to government
2.25procurement agreements of United States trade agreements;
2.26(2) assess the potential impact of government procurement agreements on the state's
2.27economy;
2.28(3) advise the governor and the legislature of the group's findings and make
2.29recommendations, including any draft legislation necessary to implement the
2.30recommendations, to the governor and the legislature;
2.31(4) determine, on a case-by-case basis, the impact of a specific government
2.32procurement agreement by requesting input from state agencies, seeking expert advice,
2.33convening public hearings, and taking other reasonable and appropriate actions;
2.34(5) provide advice on other issues related to trade agreements other than government
2.35procurement agreements when specifically requested by the governor or the legislature;
3.1(6) request information from the Office of the United States Trade Representative
3.2necessary to conduct an appropriate review of government procurement agreements or
3.3other trade issues as directed by the governor or the legislature; and
3.4(7) receive information obtained by the United States Trade Representative's single
3.5point of contact for Minnesota.
3.6 Subd. 9. Report. The Trade Policy Advisory Council shall submit a report to the
3.7chairs and ranking minority members of the legislative committees and divisions of the
3.8Senate and House of Representatives with primary jurisdiction over jobs with its findings
3.9and recommendations no less than once per fiscal year. The report shall include draft
3.10legislation to implement its recommendations.
3.11 Subd. 10. Sunset. The council will sunset January 1, 2020.
