1.1A bill for an act
1.2relating to data practices; classifying certain data collected from or provided by
1.3applicants, users, and customers of transit services in the metropolitan area;
1.4amending Minnesota Statutes 2012, section 13.72, subdivision 10, by adding a
1.5subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2012, section 13.72, subdivision 10, is amended to read:
1.8    Subd. 10. Transportation service data. Personal, medical, financial, familial, or
1.9locational information data pertaining to applicants for or users of services providing
1.10transportation for the disabled or elderly, with the exception of the name of the applicant
1.11or user of the service, are private.

1.12    Sec. 2. Minnesota Statutes 2012, section 13.72, is amended by adding a subdivision to
1.13read:
1.14    Subd. 18. Transit customer data. (a) Data on applicants, users, and customers
1.15of public transit collected by or through the Metropolitan Council's personalized Web
1.16services or the regional fare collection system are private data on individuals. As used in
1.17this subdivision, the following terms have the meanings given them:
1.18(1) "regional fare collection system" means the fare collection system created and
1.19administered by the council that is used for collecting fares or providing fare cards or
1.20passes for transit services which includes:
1.21(i) regular route bus service within the metropolitan area and paratransit service,
1.22whether provided by the council or by other providers of regional transit service;
1.23(ii) light rail transit service within the metropolitan area;
1.24(iii) rideshare programs administered by the council;
2.1(iv) special transportation services provided under section 473.386; and
2.2(v) commuter rail service;
2.3(2) "personalized Web services" means services for which transit service applicants,
2.4users, and customers must establish a user account; and
2.5(3) "metropolitan area" means the area defined in section 473.121, subdivision 2.
2.6(b) The council may disseminate data on applicant, user, and customer transaction
2.7history and fare card use to government entities, organizations, school districts,
2.8educational institutions, and employers that subsidize fares or provide fare cards or passes
2.9to their clients, students, or employees.
2.10(c) The council may disseminate transit service applicant, user, and customer data
2.11to another government entity to prevent unlawful intrusion into government electronic
2.12systems, or as otherwise provided by law.

2.13    Sec. 3. EFFECTIVE DATE.
2.14This act is effective the day following final enactment.
