1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 239.101, subdivision 3, is amended to read:
1.7 Subd. 3. Petroleum inspection fee; appropriation, uses. (a) An inspection fee is
1.8imposed (1) on petroleum products when received by the first licensed distributor, and (2)
1.9on petroleum products received and held for sale or use by any person when the petroleum
1.10products have not previously been received by a licensed distributor. The petroleum
1.11inspection fee is $1 for every 1,000 gallons received. The commissioner of revenue shall
1.12collect the fee. The revenue from 81 cents of the fee is appropriated to the commissioner of
1.13commerce for the cost of operations of the Division of Weights and Measures, petroleum
1.14supply monitoring, and to make grants to providers of low-income weatherization services
1.15to install renewable energy equipment in households that are eligible for weatherization
1.16assistance under Minnesota's weatherization assistance program state plan. The remainder
1.17of the fee must be deposited in the general fund.
1.18 (b) The commissioner of revenue shall credit a person for inspection fees previously
1.19paid in error or for any material exported or sold for export from the state upon filing of a
1.20report as prescribed by the commissioner of revenue.
1.21 (c) The commissioner of revenue may collect the inspection fee along with any
1.22taxes due under chapter 296A.
1.23(d) Of the 81 cents appropriated in paragraph (a), at least five percent shall be used
1.24to make grants to providers of low-income weatherization services to install renewable
2.1energy equipment in households that are eligible for weatherization assistance under
2.2Minnesota's weatherization assistance program state plan.
