1.2relating to animals; pet and companion animals; providing for requirements and
1.3inspection authority for commercial dog and cat breeders; appropriating money;
1.4amending Minnesota Statutes 2012, sections 346.36, by adding subdivisions;
1.5346.39, by adding subdivisions.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2012, section 346.36, is amended by adding a
1.8subdivision to read:
1.9 Subd. 2a. Cat. "Cat" means a mammal that is wholly or in part of the species Felis
1.10domesticus. An adult cat is a cat 24 weeks of age or older. A kitten is a cat under 24
1.11weeks of age.
1.12 Sec. 2. Minnesota Statutes 2012, section 346.36, is amended by adding a subdivision
1.13to read:
1.14 Subd. 2b. Commercial breeder. "Commercial breeder" means a person who
1.15possesses or has an ownership interest in dogs or cats and is engaged in the business
1.16of breeding dogs or cats to produce offspring for sale or for exchange in return for
1.17consideration and who possesses ten or more sexually intact adult breeding animals and
1.18whose animals produce more than five total litters of puppies or kittens per year.
1.19 Sec. 3. Minnesota Statutes 2012, section 346.36, is amended by adding a subdivision
1.20to read:
1.21 Subd. 3a. Dog. "Dog" means a mammal that is wholly or in part of the species
1.22Canis familiaris. An adult dog is a dog 24 weeks of age or older. A puppy is a dog
1.23under 24 weeks of age.
2.1 Sec. 4. Minnesota Statutes 2012, section 346.39, is amended by adding a subdivision
2.2to read:
2.3 Subd. 13. Sale of dogs or cats by commercial breeders. A dog or cat sold or
2.4otherwise distributed by a commercial breeder must be accompanied by a certificate of
2.5veterinary inspection completed by a veterinarian licensed to practice veterinary medicine
2.6in Minnesota. The certificate must be completed within ten days prior to the sale or
2.7distribution and must indicate that the animal was found to have no signs of infectious or
2.8contagious disease. In addition, a certificate for adult dogs that have not been spayed or
2.9neutered must indicate that the animal has been tested for canine brucellosis with a test
2.10approved by the Board of Animal Health and found to be negative.
2.11 Sec. 5. Minnesota Statutes 2012, section 346.39, is amended by adding a subdivision
2.12to read:
2.13 Subd. 14. Record requirements for commercial breeders. A commercial breeder
2.14shall keep records on each dog or cat at the facility that includes:
2.15(1) the date of acquisition and disposition;
2.16(2) the name and address of the person or entity from whom an animal was received;
2.17(3) the vaccinations given to the animal, the date of vaccination, and the name of
2.18the person who administered the vaccine;
2.19(4) all identification numbers assigned to the animal by identification tags, tattoos,
2.20or microchip;
2.21(5) description of the animal by approximate age, breed, and sex, and other
2.22distinguishing marks;
2.23(6) the name and address of the person or entity to whom an animal was transferred;
2.24and
2.25(7) disease conditions diagnosed by a veterinarian.
2.26 Sec. 6. Minnesota Statutes 2012, section 346.39, is amended by adding a subdivision
2.27to read:
2.28 Subd. 15. Investigation of complaints regarding commercial breeders. The
2.29Board of Animal Health, a local animal control authority, licensed peace officer, or humane
2.30agent appointed under section 343.01, shall initiate an investigation upon receiving
2.31a formal complaint alleging that a commercial breeder has violated the requirements
2.32specified in this section or section 346.37.
3.1 Sec. 7. Minnesota Statutes 2012, section 346.39, is amended by adding a subdivision
3.2to read:
3.3 Subd. 16. Inspection and enforcement of commercial breeder facilities. The
3.4Board of Animal Health may inspect and enforce this section and section 346.37 under the
3.5inspection and enforcement authority granted for a violation of chapter 35.
3.6 Sec. 8. BOARD OF ANIMAL HEALTH; APPROPRIATION.
3.7$....... in fiscal year 2014 and $....... in fiscal year 2015 are appropriated from the
3.8general fund to the Board of Animal Health for duties under this act.
3.9 Sec. 9. EFFECTIVE DATE.
3.10Sections 1 to 8 are effective the day following final enactment.
