AN ACT

To amend chapter 620, RSMo, by adding thereto one new section relating to workforce development.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 620, RSMo, is amended by adding thereto one new section, to be known as section 620.025, to read as follows:

            620.025. No workforce development agency shall knowingly omit an entity with whom it has a contract with in any bidding process. Any workforce development agency that knowingly omits such entity from the bidding process shall repay the entity an amount equal to twenty-five percent of the total cost of the project as recovery for loss of opportunity due to the omission. As used in this section, "knowingly" means having actual knowledge of or acting with deliberate ignorance or reckless disregard for the prohibition involved.
