AN ACT
Relating to accountability for gambling receipts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
WHEREAS, Section 313.822, RSMo, requires each excursion gambling boat to designate a city or county as its home dock; and
WHEREAS, the home dock city or county receives 10% of the taxes levied on the adjusted gross receipts of the excursion gambling boat for the purpose of providing services necessary for the safety of the public visiting the excursion gambling boat; and
WHEREAS, currently, the Missouri Gaming Commission does not have the authority to require a strict accounting of the home dock city's or county's moneys withheld for safety purposes; and
WHEREAS, transparency is vitally important to ensure that safety measures are, in fact, being taken by the home dock cities and counties with those retained moneys; and
WHEREAS, without adequate reporting and oversight by the Gaming Commission, there is insufficient accountability regarding the expenditures of those retained moneys:
NOW, THEREFORE, BE IT RESOLVED that the members of the House of Representatives of the Ninety-sixth General Assembly, First Regular Session, the Senate concurring therein, hereby authorize and direct the Missouri Gaming Commission to collect the necessary information regarding the expenditure of moneys retained under Section 313.822 by home dock cities and counties for the purpose of providing services necessary for the safety of the public visiting excursion gambling boats; and
BE IT FURTHER RESOLVED that, on or before February first of each year, the Gaming Commission shall make an annual accounting report to the general assembly detailing the specific expenditures of the tax moneys retained by each home dock city and county in this state; and
BE IT FURTHER RESOLVED that each home dock city and county cooperate with the Missouri Gaming Commission and fully and completely disclose the specific expenditures made with the moneys retained under Section 313.822. Any home dock city or county which fails to provide the required information shall forfeit the right to retain any moneys under Section 313.822 until such time as they comply with the requirements of this legislation; and
BE IT FURTHER RESOLVED that this resolution be sent to the Governor for his approval or rejection pursuant to the Missouri Constitution.
