Summary

An Act To Amend Section 41-29-139, Mississippi Code Of 1972, To Authorize County Health Departments To Operate Substance Abuse Treatment Outreach Programs That Allows Participants To Exchange Hypodermic Needles And Syringes, With The Consent Of The Municipality And County In Which The Program Would Operate; To Provide That Items Exchanged At The Program Shall Not Be Deemed To Be Drug Paraphernalia Under The Controlled Substances Law While Located At The Program; To Provide That Persons Who Admit To A Law Enforcement Officer Of The Presence Of A Needle Or Other Sharp Object Before A Search Of The Person, The Person's Premises, Or The Person's Vehicle, Shall Not Be Charged With Or Prosecuted For Possession Of Drug Paraphernalia For The Needle Or Sharp Object Or For Possession Of A Controlled Substance For Residual Or Trace Drug Amounts Present On The Needle Or Sharp Object; To Amend Section 41-29-153, Mississippi Code Of 1972, To Conform To The Preceding Provision; And For Related Purposes.
