Summary

An Act To Create The Revised Mississippi Dairy Industry Stabilization Act For The Purpose Of Revitalizing The Dairy Industry And Increasing Output Of Dairy Products In The State By Providing Financial Assistance To Dairy Producers; To Require The Commissioner Of Agriculture And Commerce To Establish The Minimum Price For Fluid Milk; To Prescribe The Process By Which The Commissioner Shall Determine The Minimum Price Using The Southern Average Cost Of Production; To Require The Commissioner To Announce And Publish The Minimum Price For Fluid Milk For The Next Calendar Year By November 1 Of Each Year And To Adjust The Price At Certain Other Times During The Year Using The Most Currently Available Southern Average Cost Of Production; To Require The Commissioner To Estimate The Quantity Of All Milk To Be Produced In The State And Marketed By Producers For Commercial Use During The Next Year By November 1 Of Each Year; To Require The Commissioner To Determine The Total Quantity Of All Milk Produced By Each Producer Or Farming Operation During The Preceding Calendar Year By February 1 Of Each Year; To Permit The Commissioner To Contract With Certain Nongovernmental Or Not-for-profit Organizations For The Purchase Of Any Surplus Fluid Milk Or Milk Products In Excess Of The State's Demand If Certain Conditions Are Met; To Permit The Commissioner To Implement A Reduction In The Minimum Price If The Commissioner Is Not Able To Contract With Those Organizations For The Purchase Of Surplus Fluid Milk Or Milk Products Capable Of Sustaining The Minimum Price, Subject To Limitation; To Authorize The Commissioner To Impose An Annual Pound Limit Upon The Amount Of Fluid Milk Allowed To Be Unloaded By Dairy Farmers Or Producers During The Calendar Year; To Authorize The Commissioner Of Agriculture And Commerce To Cooperate With And Enter Into Agreement With The Commissioner Of Corrections To Establish, Implement And Manage Dairy Production And Processing As A Component Of Prison Agricultural Enterprises; To Create The Revised Mississippi Dairy Industry Stabilization Fund; To Provide That The Mississippi Development Authority Shall Administer Such Fund For The Purpose Of Making Loans To Dairy Producers To Assist In Completing Certain Projects To Restore Hurricane Katrina Damaged Dairies, Upgrade Equipment And Refinance Debt; To Authorize The Issuance Of $10,000,000.00 In State General Obligation Bonds To Provide Funds For The Dairy Industry Stabilization Fund; To Amend Section 47-5-355, Mississippi Code Of 1972, In Conformity To The Provisions Of This Act; To Bring Forward Sections 69-2-13, 69-2-15, 69-2-17, 69-2-19, 69-2-21, 69-2-23, 69-2-25, 69-2-27, 69-2-29, 69-2-30, 69-2-31, 69-2-33, 69-2-35, 69-2-37, 69-2-39, 69-2-40 And 69-2-41, Mississippi Code Of 1972, Which Establish The Emerging Crops Fund, For Purposes Of Amendment; And For Related Purposes.
