Summary
An Act To Amend Section 43-13-116, Mississippi Code Of 1972, To Provide That When The Division Of Medicaid Denies An Applicant's Claim Of Eligibility Or Denies, Reduces Or Terminates A Recipient's Benefits, The Division Shall Provide In Writing To The Applicant Or Recipient, And To All Physicians Involved In The Process On Behalf Of The Applicant Or Recipient, All Of The Criteria For Eligibility For Those Benefits And The Specific Reasons For The Denial Of Eligibility Or The Denial, Reduction Or Termination Of The Benefits, And Shall Provide The Applicant Or Recipient With The Phone Numbers Of Consumer Assistance Programs For Medicaid Benefits; To Provide That Administrative Hearings On Eligibility Claims By Medicaid Applicants Or Recipients Will Be Held In Person, Unless The Claimant Or Representative Requests To Have The Hearing Held By Telephone; To Provide That Claimants In Administrative Hearings On Eligibility Claims Shall Have The Right To Have The Physicians Of The Division's Quality Improvement Organization Review The Claimant's Case Before The Hearing, Upon The Request Of The Claimant, And The Right To Have Present At The Hearing A Physician Or Physicians Who Have Examined The Claimant To Present Evidence Concerning The Claimant's Eligibility For Benefits; And For Related Purposes.
