AN ACT TO AMEND SECTION 11-21-15, MISSISSIPPI CODE OF 1972, TO REVISE THE APPOINTMENT OF FREEHOLDERS IN PARTITION PROCEEDINGS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 11-21-15, Mississippi Code of 1972, is amended as follows:
11-21-15. If the judgment
be for a partition of the land, it shall state the number of shares into which
the land is to be divided, and shall appoint * * * one (1) discreet freeholder,
not related to the parties by consanguinity or affinity, to make partition
according to the judgment. Either party may object to * * * the master for cause, and, in case
the objection be sustained, the place shall be filled by another appointment.
If * * * the master cannot serve, the chancellor may
fill such vacancy at any time by written appointment.
SECTION 2. This act shall take effect and be in force from and after July 1, 2013.
