House Bill 541

AN ACT TO PROHIBIT STATE OR LOCAL GOVERNMENT FROM COMPELLING A PERSON TO PURCHASE A HEALTH INSURANCE PRODUCT THAT CONTAINS A PART THAT THE PERSON CAN NEVER USE BECAUSE OF HIS PERMANENT CONDITION OR CIRCUMSTANCE, OR THAT INCLUDES MANDATORY COVERAGE FOR A SPECIFIC CONDITION OR DISEASE IF THE PERSON IS NOT ANATOMICALLY CAPABLE OF BEING IN THAT CONDITION OR HAVING THAT DISEASE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The State of Mississippi, or any local governing authority or governmental entity thereof, may not compel, directly or indirectly, any person who is a citizen of the state to purchase a health insurance product that contains a part that the person can never use because of his permanent physical or other condition or circumstance, or that includes mandatory coverage for a specific condition or disease if the person is not anatomically capable of being in that condition or having that disease. 

     SECTION 2.  This act shall take effect and be in force from and after its passage.
