AN ACT TO CREATE A NEW CODE SECTION TO BE CODIFIED AS SECTION 69-1-33, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DEPARTMENT OF AGRICULTURE AND COMMERCE TO MAKE CERTAIN FINANCIAL TRANSACTIONS FOR THE PURPOSE OF IMPROVING, MARKETING AND PROMOTING THE DEPARTMENT; TO AUTHORIZE THE DEPARTMENT TO ALLOW CERTAIN ENTITIES TO USE, PUBLISH OR ADVERTISE SUCH ENTITY'S NAME ON PROPERTY OR PUBLICATIONS UNDER THE DEPARTMENT'S JURISDICTION AND DOMAIN; TO ESTABLISH THE MISSISSIPPI DEPARTMENT OF AGRICULTURE AND COMMERCE PROMOTION FUND IN THE STATE TREASURY FOR THE PURPOSE OF PROVIDING FOR THE PAYMENT OF EXPENSES INCURRED BY THE DEPARTMENT IN ADMINISTERING THE PROVISIONS OF THIS SECTION; TO CREATE A NEW CODE SECTION TO BE CODIFIED AS SECTION 69-1-35, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DEPARTMENT TO DISPOSE OF OR SELL ANY PROPERTY OR ARTIFACTS IN ITS POSSESSION OR ON THE GROUNDS OF THE JIM BUCK ROSS MISSISSIPPI AGRICULTURE AND FORESTRY MUSEUM DEEMED OBSOLETE OR NO LONGER OF VALUE; TO PROVIDE FOR THE USE OF FUNDS RECEIVED FROM THE SALE OF SUCH PROPERTY OR ARTIFACTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 69-1-33, Mississippi Code of 1972:

     69-1-33.  (1)  The Department of Agriculture and Commerce is authorized to accept, budget, receive or expend funds from any source, public or private, for improvements to, marketing for and promotion of the department.  This section shall be construed liberally to effectuate that purpose.

     (2)  The department is authorized to allow a federal, state, governmental, public, private, commercial or charitable entity to use, publish or advertise such entity's name on property or in publications under the jurisdiction and domain of the department.  Any funds received from such an entity shall be retained by the department and expended for improvements to, marketing for and promotion of the department.  The department is authorized to accept, budget, receive or expend those received funds in accordance with rules and regulations of the Department of Finance and Administration in a manner consistent with the escalation of federal funds.

     (3)  There is established in the State Treasury a special fund to be known as the "Mississippi Department of Agriculture and Commerce Promotion Fund."  The fund shall be comprised of any funds received by the department for improvements to, marketing for and promotion of the department.  The purpose of the fund is to provide for the payment of expenses incurred by the department in its administration of this section.  Monies deposited into the fund that are unexpended at the end of a fiscal year shall not lapse into the State General Fund, and any interest earned or investment earnings on amounts in the fund shall be deposited into the fund; however, any and all funds received from this section on behalf of the museum shall be deposited into the nonbudgeted enterprise fund related to the Jim Buck Ross Mississippi Agriculture and Forestry Museum.  The enterprise funds shall be maintained in accordance with generally accepted accounting principles and regulations prescribed by the Department of Finance and Administration.

     SECTION 2.  The following shall be codified as Section 69-1-35, Mississippi Code of 1972:

     69-1-35.  The Department of Agriculture and Commerce is authorized to dispose of or sell any property or artifacts in the possession of or on the grounds of the Jim Buck Ross Mississippi Agriculture and Forestry Museum that it determines are obsolete, no longer of value or use to the museum or unclaimed by the donor. The department is authorized to receive and expend the funds from the sale of such property or artifacts for improvements to the museum grounds, and for marketing and promotion of the museum in a manner consistent with its historical purpose.  Any and all funds received by the department under the provisions of this section shall be deposited into the nonbudgeted enterprise fund related to the Jim Buck Ross Mississippi Agriculture and Forestry Museum.  The funds shall be maintained in accordance with generally accepted accounting principles and regulations prescribed by the Department of Finance and Administration.

     SECTION 3. This act shall take effect and be in force from and after its passage.
