AN ACT TO AMEND SECTION 11-1-9, MISSISSIPPI CODE OF 1972, TO CLARIFY AND REVISE THE CONTINUANCE WHEN THE LEGISLATURE IS IN SESSION OF A MATTER ON THE MOTION OF AN ATTORNEY WHO IS A MEMBER OF THE LEGISLATURE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 11-1-9, Mississippi Code of 1972, is amended as follows:
11-1-9. In any cause * * *
before any court * * *, administrative board, agency * * *, commission * * *, or
administrative agency of this state or any county or municipality of
this state in which an application for continuance is properly made, predicated
upon the ground that the counsel for the party making * * * the application is a member of the
Mississippi Legislature * * * and, if * * * the application is made * * * for a time when the Legislature is or
will be in session, either regular or extraordinary, * * * at
the time that * * *
the cause would be triable or any motion or other preliminary matter
heard, then the continuance shall be granted automatically in all
cases without hearing.
SECTION 2. This act shall take effect and be in force from and after its passage.
