AN ACT TO AUTHORIZE THE TOWN OF WALNUT GROVE, MISSISSIPPI, TO EXPAND ITS GAS DISTRIBUTION SYSTEM INTO CERTAIN AREAS IN LEAKE AND SCOTT COUNTIES, MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the Town of Walnut Grove in Leake County, Mississippi, in their discretion, may construct, expand, operate and maintain the town's gas distribution system in Leake County, Mississippi, in the following described area:

     Beginning at the Northeast corner of Section 28, Township 9 North, Range 8 East, Leake County, Mississippi; thence West 9 miles along the North section line of Sections 28, 29 and 30 of Township 9 North, Range 8 East and Sections 25, 26, 27, 28, 29 and 30, Township 9 North, Range 7 East to the Northwest corner of Section 30, Township 9 North, Range 7 East, Leake County; thence south 2.0 miles along the West section line of Sections 30 and 31, Township 9 North, Range 7 East to the Southwest corner of Section 31, Township 9 North, Range 7 East, which line is the South boundary line of Leake County; thence East 9.0 miles along the South section line of Sections 31, 32, 33, 34, 35 and 36, Township 9 North, Range 7 East and Sections 31, 32 and 33 Township 9 North, Range 8 East to the Southeast corner of Section 33, Township 9 North, Range 8 East, Leake County; thence north along the East section line of Section 33 and 28, Township 9 North, Range 8 East to the Northeast corner of said Section 28 and being the POINT OF BEGINNING, all in Leake County, Mississippi.

     (2)  Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the Town of Walnut Grove, Mississippi, in their discretion, may construct, expand operate and maintain the town's gas distribution system in Scott County, Mississippi, in the following described area:

     Beginning at the Northeast corner of West half of Section 4, Township 8 North, Range 8 East, Scott County, Mississippi, which point lies on the Leake-Scott County line; thence West 6.5 miles along the North section line of Sections 4, 5, and 6, Township 8 North, Range 8 East and Sections 1, 2, 3 and 4, Township 8 North, Range 7 East to the Northwest corner of Section 4, Township 8 North, Range 7 East, Scott County; thence South 3.0 miles along the West section line of Sections 4, 9 and 16, Township 8 North, Range 7 East to the Southwest corner of Section 16, Township 8 North, Range 7 East; thence East 6.5 miles along the South section line of Sections 16, 15, 14 and 13, Township 8 North, Range 7 East and Sections 18, 17 and 16, Township 8 North, Range 8 East, Scott County, Mississippi to the Southeast corner of West half of Section 16, Township 8 North, Range 8 East; thence North along the East boundary line of the West half of Sections 16, 9, and 4, Township 8 North, Range 8 East, Scott County to the POINT OF BEGINNING, all in Scott County, Mississippi.

     (3)  Whenever the gas utility service is furnished to any consumer residing outside the corporate limits of the town in the area described in subsections (1) and (2) of this section, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the corporate limits of the town.

     (4)  The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity from the Public Service Commission.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
