AN ACT TO PLACE CERTAIN REQUIREMENTS ON PERSONS UNDER A CERTAIN AGE WHEN RIDING ALL-TERRAIN VEHICLES; TO MANDATE CERTAIN SAFETY REQUIREMENTS; TO PROHIBIT THE USE OF ALL-TERRAIN VEHICLES ON PUBLIC ROADS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) As used in this section the term "all-terrain vehicle" means any motorized off-highway vehicle fifty (50) inches or less in width, having a dry weight of nine hundred (900) pounds or less, designed to travel on three (3) or more low-pressure tires, having a seat designed to be straddled by the operator and handlebars for steering control, and intended for use by a single operator with no passenger.
(2) No person under sixteen (16) years of age shall operate, ride, or be otherwise propelled on an all-terrain vehicle unless the person wears a safety helmet meeting United States Department of Transportation standards and eye protection.
(3) All-terrain vehicles may not be operated on the public highways, roads, or streets of this state.
(4) No person under the age of sixteen (16) shall ride or drive an all-terrain vehicle on the public lands of the state.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
