AN ACT TO CREATE A TASK FORCE TO STUDY AND MAKE RECOMMENDATIONS ON WHITE-TAILED DEER ENCLOSURES AND BREEDING PENS AND THE WHITE-TAILED BREEDING INDUSTRY; TO RECOMMEND SAFEGUARDS TO PROTECT NATIVE WILDLIFE AND DEER WITHIN SUCH ENCLOSURES; TO DETERMINE THE ECONOMIC IMPACT OF POTENTIAL DEVELOPMENT OF WHITE-TAILED DEER BREEDING INDUSTRY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is a deer breeding industry joint task force created to study and make recommendations regarding white-tailed deer enclosures and breeding pens and the deer breeding industry in the state.  The joint task force shall study and make recommendations in the following areas:

          (a)  Enclosure requirements;

          (b)  Monitoring and tagging requirements;

          (c)  Population restrictions within enclosures;

          (d)  Adequate protection of native white-tailed deer;

          (e)  The economic impact of the potential development of white-tailed breeding industry within the state;

          (f)  Prevention of the introduction of chronic wasting disease and other diseases and the transmission of diseases;

          (g)  The importation of white-tailed deer semen, ova, and embryos from outside of the state;

          (h)  Protection of the welfare and health of neglected or abandoned penned white-tailed deer;

          (i)  To determine the powers and duties of the appropriate agency to adequately regulate white-tailed enclosures and breeding pens and the deer breeding industry in the state; and

          (j)  Any other matters the task force deems necessary or desirable to regulate the deer breeding industry.

     The joint task force shall make a status report to the Senate and House Wildlife, Fisheries and Parks Committees before September 1, 2010.  The joint task force shall make a report of its findings and recommendations to the Legislature before December 1, 2010, including any recommended legislation.

     (2)  The task force shall be composed of the following members:

          (a)  The State Veterinarian;

          (b)  The Commissioner of Agriculture and Commerce, or his designee;

          (c)  The Executive Director of the Mississippi Development Authority, or his designee;

          (d)  The Executive Director of the Department of Wildlife, Fisheries and Parks, or his designee;

          (e)  The Chairman of the Senate Wildlife, Fisheries and Parks Committee;

          (f)  The Chairman of the House of Representatives Wildlife, Fisheries and Parks Committee;

          (g)  One (1) representative of Mississippi deer farmers or breeders appointed by the State Veterinarian.

     The State Veterinarian shall serve as chairman and shall set the date of the first meeting.  At the first meeting, the task force shall elect any other officers determined to be necessary and the chairman shall determine the date and locations of subsequent meetings.

     Members of the task force shall serve without compensation for their services, but may be reimbursed for necessary expenses in attending to the actual business of the task force from any available funds, as provided by law.  Legislative members shall be reimbursed only if the member uses one (1) of his or her authorized discretionary or constituent days for attendance at a meeting of the task force, but only with the specific approval of the appropriate management or rules committee.

     (3)  Any department or agency, at the request of the chairman of the task force, shall provide staff and other support necessary for the task force to perform its duties.

     (4)  The task force shall be dissolved on January 4, 2011.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
