Short Title:        Extend Coal Ash Structural Fill Moratorium.

A BILL TO BE ENTITLED

AN ACT to extend by one year the prohibition on use of coal combustion products as structural fill.

The General Assembly of North Carolina enacts:

SECTION 1.  Section 4.(a) of S.L. 2014‑122 reads as rewritten:

"SECTION 4.(a)  Notwithstanding 15A NCAC 13B .1701, et seq., and except as provided in Section 4(b) of this act, the use of coal combustion products, as defined in G.S. 130A‑309.201, as structural fill is prohibited until August 1, 2015,2016, in order to allow the Department of Environment and Natural Resources, the Environmental Management Commission, and the General Assembly time to review and evaluate the use of coal combustion residuals as structural fill."

SECTION 2.  This act is effective when it becomes law.
