HOUSE BILL 203
AN ACT relative to the unauthorized practice of law.

This bill allows certain persons who are not authorized to practice law to represent a trust that owns the premises on matters in the circuit court of New Hampshire on landlord tenant issues.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fifteen
AN ACT relative to the unauthorized practice of law.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Unauthorized Practice of Law. Amend RSA 540:30 to read as follows:
540:30 Unauthorized Practice of Law; Exception; Certain Employees and Members of Limited Liability Companies, Corporations, or Partnerships. Notwithstanding RSA 311:7, a person of good character who is not approved to practice law in New Hampshire, but is a member or employee of a limited liability company, corporation, or partnership, which has 5 or fewer members, or is the trustee and a beneficiary or is a brother, sister, son, or daughter of any of the beneficiaries of a trust that owns the premises, or is employed, either directly or indirectly, by the owner of the premises to manage the premises for the owner, shall, with the proper written authorization from the owner, trust, or organization, be authorized to represent the entity on matters in the circuit court of New Hampshire arising under this chapter and RSA 503; provided that each such appearance shall require a new written authorization and in cases under RSA 503 the subject is a landlord/tenant dispute.
2 Effective Date. This act shall take effect January 1, 2016.
