AN ACT relative to the definition of a way.

ANALYSIS

 

This bill repeals the alternate definition of "way" for purposes of the driving after suspension or revocation statute.

 

This bill is at the request of the department of justice.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to the definition of a way.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Way; Definition.  Amend RSA 259:125, I to read as follows:

I. Except as provided in [paragraphs] paragraph II [and III], the entire width between the boundary lines of any public highway, street, avenue, road, alley, park or parkway, or any private way laid out under authority of statute, or any such way provided and maintained by a public institution to which state funds are appropriated for public use, or any such way which has been used for public travel thereon, other than to and from a toll bridge or ferry, for 20 years, or any public or private parking lot which is maintained primarily for the benefit of paying customers;

2  Repeal.  RSA 259:125, III, relative to an additional definition of "way", is repealed.

3  Effective Date.  This act shall take effect January 1, 2026.
