STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT establishing a statutory commission on motor vehicle recycling issues.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Commission on Motor Vehicle Recycling. Amend RSA 236 by inserting after section 129 the following new section:
236:129-a Commission on Motor Vehicle Recycling.
I. There is established a commission to study motor vehicle recycling issues.
II. The members of the commission shall be as follows:
(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(b) One member of the senate, appointed by the president of the senate.
(c) The commissioner of the department of environmental services, or designee.
(d) The commissioner of the department of safety, or designee.
(e) The commissioner of the department of transportation, or designee.
(f) One representative from the Auto & Truck Recyclers Association of New Hampshire, appointed by the association.
(g) One representative from the scrap processors industry, appointed by the speaker of the house of representatives.
(h) One representative from the Alliance of Automobile Manufacturers, appointed by the speaker of the house of representatives.
(i) One representative from the New Hampshire Automobile Dealers Association, appointed by the association.
(j) One representative from the New Hampshire Municipal Association, appointed by the association.
(k) One representative from Northeast Resource Recovery Association, appointed by the association.
(l) One representative from the insurance industry, appointed by the speaker of the house of representatives.
III. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
IV. The commission shall study the adequacy of the state’s regulatory system and the industry infrastructure currently used to recycle and dispose of end-of-life motor vehicles and make recommendations for change and determine if current practices are adequate to protect the environment.
V. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.
VI. Beginning November 1, 2011 and each November 1 thereafter, the commission shall make an annual report of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the chairperson of the house executive departments and administration committee, the chairperson of the environment and agriculture committee, the house clerk, the senate clerk, the governor, and the state library.
2 Repeal. RSA 236:129-a, relative to the motor vehicle recycling commission, is repealed.
3 Effective Date.
I. Section 2 of this act shall take effect November 1, 2013.
II. The remainder of this act shall take effect upon its passage.
