STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to construction of a public pier on Hampton Beach and making an appropriation therefor.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Hampton Beach State Park Pier Fund. Amend RSA 216-J by inserting after section 5 the following new section:
216-J:6 Hampton Beach State Park Pier Fund. There is hereby established in the office of the state treasurer a fund to be known as the Hampton Beach State Park pier fund for the purposes of the engineering services, siting, permitting, final design, construction, and ongoing maintenance for a proposed pier at Hampton Beach State Park. The fund shall be nonlapsing and continually appropriated to the department of natural and cultural resources. The department may accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund.
2 New Subparagraph; State Treasurer; Application of Receipts; Hampton Beach State Park Pier Fund. Amend RSA 6:12, II(b) by inserting after subparagraph 399 the following new subparagraph:
(400) Moneys deposited in the Hampton Beach State Park pier fund as established in RSA 216-J:6.
3 Department of Natural and Cultural Resources; Hampton Beach State Park Pier; Appropriation. The sum of $12,000,000 for the biennium ending June 30, 2027, is hereby appropriated to department of natural and cultural resources for deposit in the Hampton Beach State Park pier fund, as established in RSA 216-J:6, for the purposes of constructing an accessible public pier at Hampton Beach. The department shall take into consideration the recommendations and findings in the October 28, 2022, Hampton Beach New Pier Feasibility Study conducted by the Hampton Area Chamber of Commerce and the Department of Natural and Cultural Resources. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
4 Effective Date. This act shall take effect July 1, 2025.

METHODOLOGY:
This bill establishes the Hampton Beach State Park Pier Fund, a dedicated non-lapsing and continually appropriated fund to be administered by the Department of Natural and Cultural Resources for the purpose of siting, permitting, design, and construction of an accessible public pier at Hampton Beach. The bill makes a $12,000,000 general fund appropriation to the Department of Natural and Cultural Resources, for the biennium ending June 30, 2027, to be deposited into the fund.
The Department of Natural and Cultural Resources indicates the bill directs Department to consider the recommendations and findings of the Hampton Beach New Pier Feasibility Study, dated October 28, 2022. The Department notes the bill cites the Hampton Beach Chamber of Commerce as conducting the Feasibility Study, however the study was conducted by the Hampton Beach Area Commission. The bill authorizes the Department to accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund. Depending on the type of pier constructed, the cost estimate ranged from $21.7 million to $27.4 million. The cost estimate summary from the October 2022 report included a 25% construction contingency based on the high-level stage of design and 40% inflation assuming a 10-year time line for development, design, permitting, funding and construction. The cost estimate assumes a 25-50 year life cycle for the pier, depending on the type of pier constructed. Routine inspection and maintenance are expected to occur at 5 to 10 year intervals throughout the life of the pier according to the report. The report is based 2022 costs and assumed typical construction methods. The estimates did not include emergency repairs to the structure that may caused by unanticipated storm damage.
The Department states there will be additional indeterminable annual costs for project oversight, additional seasonal staff, and maintenance costs not covered by the pier fund. The Department expects those costs will be paid from the State Park Fund and will range from $10,000-$100,000. The proposed pier is intended to serve the general public, including recreational fishermen.
