AN ACT relative to parental access to a minor child's medical records.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to parental access to a minor child's medical records.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Medical Records; Parental Access.  Amend RSA 332-I:1 by inserting after paragraph I the following new paragraph:

I-a.  Except when specifically protected under RSA 141-C:18, RSA 141-F:7, RSA 135-C:19-a, or 45 C.F.R. § 160.502, or prohibited by an order of a court of competent jurisdiction, a parent of a minor child shall be entitled to have full and complete access to the medical records of the minor child.

2  Effective Date.  This act shall take effect 60 days after its passage.
