STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT prohibiting the sale or possession of sky lanterns.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Sky Lanterns. Amend RSA 153 by inserting after section 5-c the following new section:
153:5-d Retail Sale or Possession of Sky Lanterns Prohibited. The possession or retail sale of sky lanterns is prohibited. As used in this section, “sky lantern” means an unmanned aerial luminaries balloon requiring fire underneath for propulsion. Whoever shall violate the provisions of this section shall be subject to the penalty in RSA 153:24.
2 Effective Date. This act shall take effect January 1, 2015.

SB 403-FN - FISCAL NOTE
AN ACT prohibiting the sale or possession of sky lanterns.
FISCAL IMPACT:
The Judicial Branch states this bill, as introduced, may increase state expenditures by an indeterminable amount in FY 2015 and each year thereafter. There will be no impact on state revenue, or county and local revenues or expenditures.
METHODOLOGY:
The Judicial Branch states this bill would prohibit the possession or retail sale of sky lanterns, with the penalty being a violation for a natural person or an unspecified misdemeanor for any other person. The Judicial Branch states it cannot estimate how many additional violation or misdemeanor cases there will be as a result of this bill, but does have the following average costs per case type in the District Division of the Circuit Court, for informational purposes:

The Branch adds that if a case were to be appealed, cost per case could be significantly higher.
