AN ACT relative to establishing a commission to study the impacts of electric vehicles, lithium-ion batteries, and e-mobility devices on first responder response, the environment, building and fire codes, and life and safety property protection.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to establishing a commission to study the impacts of electric vehicles, lithium-ion batteries, and e-mobility devices on first responder response, the environment, building and fire codes, and life and safety property protection.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Commission to Study the Impacts of Electric Vehicles, Lithium-ion Batteries and E-mobility Devices on First Responder Response, the Environment, Building and Fire Codes, Life Safety, and Property Protection.  Amend RSA 154 by inserting after section 154:8-c the following new section:

154:8-d Commission to Study the Impacts of Electric Vehicles, Lithium-ion Batteries and E-mobility Devices on First Responder Response, the Environment, Building and Fire Codes, Life Safety, and Property Protection.

I.  There is established a commission to study the impacts of electric vehicles, lithium-ion batteries and e-mobility devices on first responder response, the environment, building and fire codes, life safety, and property protection.

II.  Notwithstanding RSA 14:49, the members of the commission shall be as follows:

(1)  One member of the senate, appointed by the president of the senate.

(2)  Two members of the house of representatives, one of whom shall be from the criminal justice and public safety committee, one of whom shall be from the executive departments and administration committee, and one of whom shall be from the committee, appointed by the speaker of the house of representatives.

(3)  The commissioner of safety, or designee;

(4)  The insurance commissioner, or designee;

(5) The commissioner of the department of transportation, or designee;

(6)  The commissioner of the department of environmental services, or designee;

(7)  The state fire marshal, or designee;

(8)  The director of the division of motor vehicles, or designee;

(9)  A representative of the New Hampshire Municipal Association, appointed by the association;

(10)  A fire chief, appointed by the New Hampshire Association of Fire Chiefs;

(11)  One member appointed by the New Hampshire Auto Dealer's Association;

(12)  One member appointed by the New Hampshire Tow Association;

(13)  One member appointed by the New Hampshire Association of Chiefs of Police;

(14)  A representative of the Professional Firefighters of New Hampshire, appointed by that organization.

II.(a) The commission shall study:

(1)  The occurrence of electric vehicle, lithium-ion battery and e-mobility device fire department responses in New Hampshire;

(2)  The impacts to public safety response and personal protective equipment.

(3)  The impacts to the built environment;

(4)  The impacts to the environment to include air, water and ground pollution;

(5)  The impacts to the state transportation system;

(6)  Cost and administration of first responder training;

(7)  The impacts to the state building and fire codes.

III.  The commission may solicit input from any person or entity the commission deems relevant to its study.

IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Eight members of the commission shall constitute a quorum.

V. On or before November 1, 2024, the commission shall submit an interim report of its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library and shall submit a final report on or before November 1, 2025.

2  Prospective Repeal.  RSA RSA 154:8-d, relative to establishing a commission to study the impacts of electric vehicles, lithium-ion batteries, and e-mobility devices on first responder response, the environment, building and fire codes, and life and safety property protection, is repealed.

3  Effective Date.

I.  Section 2 of this act shall take effect November 1, 2025.

II.  The remainder of this act shall take effect upon its passage.
