AN ACT allowing a waiver for certain transportable cooking devices.

ANALYSIS

This bill allows a waiver from the food licensure law for a transportable outdoor pizza oven; provided, that the applicant for the waiver proves suitable access to necessary facilities. This bill grants the commissioner of the department of health and human services rulemaking authority for the purposes of the bill.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT allowing a waiver for certain transportable cooking devices.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Waiver Authorized. Amend RSA 143-A by inserting after section 4 the following new section:

143-A:4-a Waiver Authorized. A person operating a transportable outdoor pizza oven may apply for a waiver from licensure under this section, provided, that such applicant shall prove suitable access to necessary facilities even if the facilities are not in the same building. The commissioner shall adopt rules under RSA 541-A relative to the proper administration of this section.

2 New Paragraph; Rulemaking Added. Amend RSA 143-A:9 by inserting after paragraph X the following new paragraph:

XI. Application procedures, a definition of suitable access, and other procedures for the purposes of RSA 143-A:4-a.

3 Effective Date. This act shall take effect January 1, 2014.
