An Act concerning compensation for school district superintendents and supplementing chapter 17 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding the maximum annual salary amount for a superintendent prescribed by N.J.A.C.6A:23A-3.1 or the provisions of any other law or regulation to the contrary, a board of education in its discretion may pay a stipend, in an amount determined by the board but not to exceed $50,000, to a superintendent if:

     (1) the superintendent performs additional duties beyond the role of superintendent, which duties are typically performed by other employees of the school district; and

     (2) the board of education certifies to the Commissioner of Education that, if the superintendent did not perform these additional duties, the board would need to hire additional employees to perform the work.

     b.    A board of education may not pay a stipend to a superintendent pursuant to subsection a. of this section unless the school district's budget is within the district's tax levy growth limitation as calculated pursuant to section 3 of P.L.2007, c.62 (C.18A:7F-38), and the superintendent stipend does not cause the district to exceed that growth limitation.

 

     2. This act shall take effect immediately.

 

 

STATEMENT

 

     State Board of Education regulations at N.J.A.C.6A:23A-3.1 prescribe salary caps for school district superintendents in New Jersey.  Notwithstanding the salary caps, this bill would authorize a board of education in its discretion to pay a stipend of up to $50,000 to a superintendent who performs additional duties that are typically performed by other employees of the school district.  The board of education would be required to certify to the Commissioner of Education that, if the superintendent did not perform the additional duties, the board would need to hire additional employees to perform the work.   The bill specifies that a board of education may not pay a stipend to a superintendent pursuant to the bill's provisions unless the school district's budget is within the district's tax levy cap and the stipend does not cause the district to exceed that cap.

     In some school districts, the superintendent may perform duties beyond the typical superintendent position, such as serving as a school principal, taking on teaching responsibilities, or performing other administrative or educational roles.  This bill would allow boards of education in their discretion to pay a stipend to superintendents who perform these additional duties and responsibilities, notwithstanding the superintendent salary caps.
