An Act concerning hazardous waste transporter fees and supplementing P.L.1970, c.39 (C.13:1E-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The fee schedule for a hazardous waste transporter shall be assessed on the basis of the manifests transported during quarterly periods, ending on March 31, June 30, September 30, and December 31 of each year. Within 30 days after the end of each quarterly reporting period, a transporter shall report to the Department of Environmental Protection, on forms prescribed by the department, the total quantities of materials manifested for transport by the transporter during that reporting period, along with other information as may be required by the department. The report shall be accompanied by payment in full of the fee due on the amounts manifested for transport by the transporter during the quarterly reporting period.
b. The department may adjust the fee quarterly at least 30 days before the beginning of each quarterly reporting period. The fee shall not increase by more than $0.50 per ton for each quarterly reporting period.
c. A hazardous waste transporter who violates subsection a. of this section may, in addition to the penalties prescribed under the "Solid Waste Management Act," P.L.1970, c.39 (C.13:1E-1 et seq.), be assessed a civil administrative penalty of up to $5,000.
2. This act shall take effect immediately and become operative on January 1 next following the date of enactment.
STATEMENT
This bill would create a quarterly reporting and fee payment cycle for hazardous waste transporters.
Currently under the "Solid Waste Management Act," hazardous waste transporters are billed annually in the new State fiscal year based on shipments made in the previous calendar year.
Under this bill, the Department of Environmental Protection (DEP) would establish the hazardous waste transporter fee at least 30 days before the beginning of each new quarterly reporting period. Transporters would pay the fee on a quarterly basis within 30 days after the end of each quarterly period, ending on March 31, June 30, September 30, and December 31. This quarterly schedule will improve the collection of fees by transporters and make the fee payment to the DEP more accurately reflect actual costs, rather than transporters being charged for manifests on a retroactive basis. The bill provides the DEP with the opportunity to adjust the hazardous waste transporter fee quarterly, instead of annually, and the fee may not increase more than $0.50 per ton in any given quarterly reporting period, thus avoiding an abrupt or steep increase in fees in one year.
This bill requires transporters to report to the DEP the manifest and tonnage shipped in a quarterly period within 30 days. A transporter violating the bill could be assessed a civil administrative penalty of up to $5,000, in addition to any other applicable penalties for violation of the "Solid Waste Management Act."
This bill would provide the DEP with a more efficient system to collect hazardous waste transporter fees, while also providing a predictable, efficient, and business-friendly fee schedule for hazardous waste transporters.
