     Requires that automated external defibrillators be located on every floor of State House and State House Annex; requires training for State Police.

An Act concerning automated external defibrillators and supplementing P.L.1999, c.34 (C.2A:62A-23 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  At least one automated external defibrillator, as defined in section 2 of P.L.1999, c.34 (C.2A:62A-24), shall be placed in an accessible location on every floor of the State House and the State House Annex.

     b.    Employees of the State House or State House Annex who volunteer to assist in the facilitation of fire drills in the State House Complex shall be encouraged to receive training in cardiopulmonary resuscitation and the use of an automated external defibrillator. 

     c.     A person who knowingly or intentionally tampers with, damages, or misuses an automated external defibrillator placed pursuant to subsection a. of this section is guilty of a petty disorderly person's offense and may be responsible for the cost of repair or remediation of any damage caused to the defibrillator.   

 

     2.    All members of the State Police shall be trained in the use of an automated external defibrillator in accordance with the provisions of section 3 of P.L.1999, c.34 (C.2A:62A-26).

 

     3.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill requires that an automated external defibrillator be placed on every floor of the State House and State House Annex.  Under the provisions of the bill, employees of the State House or State House Annex who assist in the facilitation of fire drills in the State House Complex are to be encouraged to receive training in cardiopulmonary resuscitation and the use of a defibrillator.  The bill provides that a person who knowingly tampers with, damages, or misuses a defibrillator would be guilty of a petty disorderly person's offense, and may be responsible for the cost of repairing any damage to the defibrillator.  A petty disorderly person's offense is punishable by up to 30 days imprisonment, a fine of up to $500, or both.  Finally, the bill requires that all members of the State Police be trained to use an automated external defibrillator. 

     Under current law, a person is prohibited from using a defibrillator unless that person has successfully completed and holds a current certification in cardio-pulmonary resuscitation and use of a defibrillator.  Current law also requires that the owner of a
defibrillator maintain the equipment, and grants that owner immunity from civil liability for any personal injury resulting from the use of the equipment.
