     Requires State Board of Education to promulgate policy regarding outside employment of superintendents of schools.

An Act concerning superintendents of schools and supplementing chapter 17 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The State Board of Education shall promulgate rules and adopt policies, subject to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), regarding outside employment for superintendents of schools.  The policy shall include, but need not be limited to, provisions to:

     a.     prohibit any outside employment which interferes with the performance of the duties of the office of superintendent;

     b.    prohibit any outside employment which creates a conflict of interest or an appearance that such a conflict of interest exists with the office of superintendent;

     c.     prohibit any outside employment being performed during the approved contractual work schedule of the superintendent or on school grounds;

     d.    require that the board of education's annual performance evaluation of the superintendent, required pursuant to section 6 of P.L.1991, c.267 (C.18A:17-20.3), include a review of any outside employment of the superintendent and an evaluation of the impact the outside employment has had on performance;

     e.     require that the superintendent annually report to the board of education any outside employment, and promptly notify the board of any new outside employment arising after the annual notification has occurred; and

     f.     require the inclusion in an employment contract between a board of education and a superintendent a provision that permits the board, upon a vote of a majority of its members, to immediately terminate the contract without any penalty to the board if the board finds that the superintendent has violated the State board's policy regarding outside employment.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the State Board of Education to promulgate rules and adopt policies regarding outside employment for superintendents of schools.  Pursuant to the bill, the policy must include the following provisions:

·        a prohibition on outside employment which interferes with the performance of the duties of the office of superintendent;

·        a prohibition on outside employment which creates a conflict of interest or an appearance that such a conflict of interest exists with the office of superintendent;

·        a prohibition on outside employment being performed during the approved contractual work schedule of the superintendent or on school grounds;

·        a requirement that the board of education's annual performance evaluation of the superintendent include a review of any outside employment and an evaluation of the impact the outside employment has had on performance;

·        a requirement that the superintendent annually report to the board of education any outside employment; and

·        a requirement that a superintendent's employment contract include a provision that permits the board to immediately terminate the contract without any penalty to the board if the board finds that the superintendent has violated the State board's policy regarding outside employment.
