SYNOPSIS

     Provides that members of Legislature employed in local government or public education must take approved leave of absence without pay from public employment for legislative duties.

An Act restricting members of the Legislature to time off from public employment only as approved leave of absence without pay and amending P.L.1979, c.277 and N.J.S.18A:6-8.1.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.1979, c.277 (C.40A:9-7.2) is amended to read as follows:

     1.    Any person employed by any county, municipality, or agency thereof who is a member of the Senate or General Assembly of the State of New Jersey shall be  entitled to [time off from his duties as such employee, without loss of pay] an approved leave of absence, without pay, from his duties as such employee, during the periods of his attendance at regular or special sessions of the Legislature and hearings or meetings of any legislative committee or commission.

     2.    N.J.S.18A:6-8.1 is amended to read as follows:

     18A:6-8.1.  Leave of certain employees to serve in legislature

     Any person employed by a public educational system or institution in a position which requires a certificate issued by the state board of examiners, or employed in a professional educational capacity by a school, college, or university which is either tax-supported or operated under contract with the state or on behalf of the state, who is a member of the senate or general assembly of the state of New Jersey, shall be entitled to [time off from his duties as such employee, without loss of pay] an approved leave of absence, without pay, from his duties as such employee, during the periods of his attendance at regular or special sessions of the legislature and hearings or meetings of any legislative committee or commission.

     3.    This act shall take effect January 1 next following enactment.

 

 

STATEMENT

 

     This bill restricts members of the Legislature to time off from employment with a county or municipality or an agency thereof, board of education or public institution of higher education only as approved leave of absence without pay for their time attending sessions, hearings, or meetings of the Legislature.  Under current law, legislators are entitled to time off without loss of pay.
